FRAMEWORK CONTRACT for the LINK electric scooter rental service

PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS OUT THE LEGALLY BINDING TERMS AND CONDITIONS FOR USE OF THE SERVICE.

ARTIGO 1 – DEFINIÇÕES

ARTICLE 1 - DEFINITIONS

"App LINK" ou "App": a aplicação de software Superpedestrian para sistemas operativos como o Android / IOS instalado e em funcionamento em dispositivos, através da qual o Utilizador interage com o Serviço.

"App LINK" or "App": the Superpedestrian software application for operating systems such as Android / IOS installed and running on devices, through which the User interacts with the Service.

"Área Operacional": a área da cidade onde se encontra a trotinete no momento do Aluguer, como resultado do Mapa;

"Operational Area": the area of the city where the scooter is located at the time of Rental, as a result of the Map;

"Cartão de crédito": o cartão de crédito do Utilizador emitido por um banco e cujos dados são indicados pelo Utilizador como parte do procedimento de registo na Aplicação;

"Credit card": the User's credit card issued by a bank and whose details are indicated by the User as part of the registration procedure in the Application;

"Carteira": a aplicação LINK contém uma carteira na qual o Utilizador pode adicionar fundos à sua conta.

"Wallet": the LINK application contains a wallet in which the User can add funds to his account.

"Código": o código de identificação e controlo da trotinete em código QR e formato numérico localizado no dístico de identificação colocado no volante de cada trotinete; DL 181/2012 art. 6º nº5.

"Code": the identification and control code of the scooter in QR code and numeric format located on the identification badge placed on the steering wheel of each scooter; DL 181/2012 art. 6º nº5.

"Código da Estrada": o Código da Estrada em vigor em Portugal e qualquer regulamentação complementar.

"Highway Code" means the Highway Code in force in Portugal and any complementary regulations.

“Confirmação na App”: Assinatura do Contrato de aquisição do Serviço com obrigação de pagamento e cumprimento dos termos e condições do Contrato de prestação do Serviço.

"Confirmation in App": Signing of the Contract to purchase the Service with an obligation to pay and comply with the terms and conditions of the Contract to provide the Service.

"Conta": Espaço virtual com o sistema de identificação de Utilizador para aceder à área pessoal da Aplicação, bem como para celebrar contratos de utilização das trotinetes e de utilização do Serviço; efetuar pagamentos, submeter e acompanhar pedidos e consular histórico de utilização.

"Account": Virtual space with the User identification system to access the personal area of the Application, as well as to enter into contracts for the use of the scooters and the use of the Service; make payments, submit and track requests and consulate usage history.

"Contrato Superpedestrian" ou "Contrato": o Acordo entre o Utilizador e a Superpedestrian, celebrado à distância através da App, regido pelos presentes Termos e Condições que tem como objeto a prestação do Serviço através da celebração de contratos individuais com os dados fornecidos pelo Utilizador e pode ser guardado num suporte duradouro como Disco rígido de computador, CD-ROM, USB, em servidores em cloud, outro qualquer suporte que que permita ao Utilizador ou à Empresa armazenar informações que lhe sejam pessoalmente dirigidas, e, mais tarde, aceder-lhes pelo tempo adequado à finalidade das informações, e que possibilite a respetiva reprodução inalterada; cfr. art. 3º do LD 24/2014;.

"Superpedestrian Contract" or "Contract": the Agreement between the User and Superpedestrian, concluded remotely through the App, governed by these Terms and Conditions that has as its object the provision of the Service through the conclusion of individual contracts with the data provided by the User and may be stored on a durable medium such as computer hard disk, CD-ROM, USB, on cloud servers, any other medium that allows the User or the Company to store information that is personally addressed to them, and later access them for the time appropriate to the purpose of the information, and that enables their reproduction unchanged;

"Customer Service": Centro de Apoio ao Cliente disponível através de linha telefónica permanente com o nº +351 308 810 313, via e-mail em support@link.city

"Customer Service": Customer Support Center available through a permanent phone line with the number +351 308 810 313, and via e-mail at support@link.city

“Dados”: Informação fornecida pelo Utilizador que se enquadra na definição dada pelo Regulamento Geral de Proteção de Dados (RGPD) e pela Lei 58/2019 de 8 de Agosto na redação em vigor, designadamente os dados de acesso que permitem o registo como Utilizador, e os recolhidos após o registo, durante a utilização do Serviço respeitantes às operações realizadas na App, incluindo viagens realizadas.

"Data": Information provided by the User that falls within the definition given by the General Data Protection Regulation (GDPR) and Law 58/2019 of August 8 in its current wording, namely the access data that allow registration as a User, and those collected after registration, during the use of the Service concerning the operations performed in the App, including trips made.

"Dispositivo": o dispositivo de telemóvel utilizado pelo Utilizador para utilizar o Serviço;

"Device": means the cell phone device used by the User to use the Service;

"Identificação e Contactos": Primeiro e último nome do utilizador e número de telefone de forma a estabelecer contacto imediato em caso de necessidade, fornecidas pelo Utilizador no momento do registo.

"Identification and Contacts": First and last name of the user, and telephone number in order to establish immediate contact in case of need, provided by the User at the time of registration.

“Empresa”: A proprietária prestadora do Serviço e da App, com a designação Superpedestrian Portugal Unipessoal, Lda, com sede social em Rua Tomás Ribeiro 6, 1ºEsquerdo, 1050-229 Lisboa, titular do NIPC 516384317

"Company": The owner of the Service and App, Superpedestrian Portugal Unipessoal, Lda, with headquarters at Rua Tomás Ribeiro 6, 1ºEsquerdo, 1050-229 Lisbon, holder of NIPC 516384317

"Mapa": o mapa específico da cidade onde a Superpedestrian presta o Serviço, que contém restrições geográficas.

"Map": the specific map of the city where Superpedestrian provides the Service, which contains geographical restrictions.

"Período de Aluguer": o período de execução de cada contrato que se estende desde a confirmação da ativação da trotinete e termina com a devolução efetiva da própria trotinete;

"Rental Period": the period of execution of each contract that extends from the confirmation of the activation of the scooter and ends with the actual return of the scooter itself;

“Registo do Utilizador”: Processo de adesão ao Serviço que viabiliza a celebração do contrato entre o Utilizador / Cliente e a Empresa, de acordo com os presentes termos e Condições de Utilização e a legislação portuguesa em vigor.

"User Registration": Process of adherence to the Service that enables the conclusion of the contract between the User/Client and the Company, in accordance with these terms and conditions of use and the Portuguese legislation in force.

"Regulamentos": a legislação nacional e local em vigor em Portugal e na cidade onde o Serviço é prestado no momento da celebração do Contrato, com especial referência ao Código da Estrada e regulamentos complementares.

"Regulations": the national and local legislation in force in Portugal and in the city where the Service is provided at the time of the conclusion of the Contract, with special reference to the Highway Code and complementary regulations.

"Sanções": as medidas de penalização aplicáveis aos Utilizadores em caso de violação do Contrato, tal como indicado no Plano Tarifário;

"Sanctions”: the penalty measures applicable to Users in case of breach of the Contract, as indicated in the Tariff Plan;

"Serviço Superpedestrian" ou "Serviço" ou "Aluguer": o serviço de aluguer das trotinetes, bem como serviços relacionados ou ligados, tais como a localização da trotinete em conformidade com o Contrato;

"Superpedestrian Service" or "Service" or "Rental": the service of renting the scooters, as well as related or connected services, such as locating the scooter in accordance with the Contract;

"Site": sítio institucional da Superpedestrian, disponível na Internet nos URL superpedestrian.com e link.city

"Site": Superpedestrian's company websites, available on the Internet at the URLs superpedestrian.com and link.city

"Superpedestrian" ou "Empresa": Superpedestrian Portugal Unipessoal, Lda, com sede social em Rua Tomás Ribeiro 6, 1ºEsquerdo, 1050-229 Lisboa, titular do NIPC 516384317.

"Superpedestrian" or "Company": Superpedestrian Portugal Unipessoal, Lda, with registered office at Rua Tomás Ribeiro 6, 1ºEsquerdo, 1050-229 Lisboa, holder of NIPC 516384317.

"Tabela de Tarifas": as condições económicas referidas no art. 16º do Contrato;

"Fee Schedule": the economic conditions referred to art. 16 of the Contract;

"Termos e Condições": as presentes condições gerais do contrato que regem e constituem uma parte integrante e substancial de cada Contrato;

"Terms and Conditions": the present general conditions of contract which govern and constitute an integral and substantial part of each Contract;

"Trotinete": a trotinete fornecida pela Superpedestrian, com a marca LINK, e utilizada pelos Utilizadores para utilizar o Serviço equiparada a velocípede com motor nos termos do artigo 112º do Código da Estrada e sujeita às mesmas regras de condução.

"Scooter": the scooter provided by Superpedestrian, with the LINK brand name, and used by Users to use the Service is equivalent to a motorized bicycle under the terms of article 112 of the Highway Code and is subject to the same driving rules.

"Utilizador / Cliente": a pessoa singular com mais de 18 anos, que cumpre os requisitos estabelecidos nestes Termos e Condições da Superpedestrian.

"User / Customer": the natural person over the age of 18, who meets the requirements set forth in these Superpedestrian Terms and Conditions.

ARTIGO 2 – SERVIÇO

ARTICLE 2 - SERVICE

2.1 O Serviço permite ao Utilizador utilizar uma ou mais vezes uma trotinete na Área Operacional, nos termos do contrato e em conformidade com os Regulamentos.

2.1 The Service allows the User to use a scooter in the Operational Area one or more times, under the terms of the contract and in accordance with the Regulations.

2.2 Para cada utilização da trotinete, mediante Ativação da App é formalizado um Contrato entre o Utilizador e a Superpedestrian ao qual se aplicam os presentes Termos e Condições e o Plano Tarifário publicado à data do Contrato na Aplicação.

2.2 For each use of the scooter, upon Activation of the App, a Contract is formalized between the User and Superpedestrian to which the present Terms and Conditions and the Tariff Plan published on the date of the Contract in the Application apply.

ARTIGO 3 - REQUISITOS PARA A UTILIZAÇÃO DO SERVIÇO

ARTICLE 3 - REQUIREMENTS FOR USING THE SERVICE

3.1. Para utilizar o Serviço, o Utilizador deve:

• Ter atingido a idade da maioridade (18);

• Possuir um cartão de crédito e/ou um cartão de débito;

• Ter um Dispositivo que satisfaça os requisitos técnicos da Aplicação. A Empresa não garante qualquer compatibilidade técnica entre a Aplicação e o Dispositivo do utilizador e não assume qualquer responsabilidade em relação à conformidade do Dispositivo do utilizador com os requisitos técnicos da Aplicação;

• Efetuar o Registo na Aplicação e aceitar os Termos e Condições.

3.1 To use the Service, the User must:

• Have reached the age of majority (18);

• Have a credit card and/or a debit card;

• Have a Device that meets the technical requirements of the App. The Company does not guarantee any technical compatibility between the App and the user's Device and does not assume any responsibility regarding the conformity of the user's Device with the technical requirements of the App;

• Register to the App and accept these Terms and Conditions.

3.2 Durante cada período de aluguer e até ao final do período de aluguer, o Utilizador deve também dispor de um serviço de ligação de dados.

3.2 During each rental period and until the end of the rental period, the User must also have a data connection service.

3.3 Os requisitos devem ser mantidos durante o período de vigência do Acordo. O não cumprimento de um ou mais requisitos deve ser imediatamente comunicado por escrito ao Serviço ao Cliente, que pode suspender o Serviço e, se necessário, rescindir o Contrato. A Empresa tem o direito de recusar a prestação do Serviço, com base em incumprimento anterior de condições de utilização do Serviço, ou na experiência anterior insatisfatória da Empresa com o Utilizador ou ainda com qualquer outra empresa que opere no sector de aluguer de automóveis/bike/trotinetes elétricas, desde que, e só se, legalmente acessível.

3.3 The requirements must be maintained during the term of the Agreement. Failure to comply with one or more requirements must be immediately reported in writing to the Customer Service, which may suspend the Service and, if necessary, terminate the Agreement. The Company has the right to refuse to provide the Service, based on previous non-compliance with conditions of use of the Service, or on the Company's previous unsatisfactory experience with the User or with any other company operating in the car/bike/electric scooter rental industry, provided that, and only if, legally accessible.

ARTIGO 4: PROCEDIMENTO DE REGISTO DO UTILIZADOR NA APLICAÇÃO E CELEBRAÇÃO DO CONTRATO

ARTICLE 4: USER REGISTRATION PROCEDURE IN THE APP AND CONCLUSION OF THE CONTRACT

4.1 Para poder utilizar o Serviço, o Utilizador deve registar-se na aplicação e obter uma Conta.

4.1 In order to use the Service, You must register with the app and obtain an Account.

4.2 O Utilizador não pode autorizar terceiros a utilizar a sua Conta, nem transferir ou permitir o acesso à sua Conta a qualquer outra pessoa ou entidade para aceder ou utilizar os serviços.

4.2 The User may not authorize any third party to use their Account, nor transfer or allow access to their Account to any other person or entity to access or use the Services.

4.3 Ao completar o procedimento de Registo na Aplicação, o Utilizador:

• Declara ter lido e compreendido os Termos e Condições e a Política de Privacidade e não ter qualquer objeção ou reserva aos mesmos;

• Toma conhecimento dos seus direitos em termos de proteção de dados, elencados na Política de Privacidade anexa a estes termos e condições e repetidos por súmula no art. 21º destes Termos e Condições;

• Declara ter guardado e/ou imprimido uma cópia da Política de Privacidade e destes Termos e Condições;

• Aceita de forma integral, inequívoca e sem reservas os Termos e Condições para a celebração do Contrato de forma integral, inequívoca e sem reservas;

• Aceita de forma integral, inequívoca e sem reservas a Tabela de Taxas.

• Aceita a cobrança automática das tarifas associadas ao Serviço.

• Introduziu todos os Dados obrigatórios para Registo.

4.3 By completing the Registration procedure on the App, the User:

• Declares to have read and understood the Terms and Conditions and the Privacy Policy and to have no objection or reservation to those;

• Is aware of his/her rights in terms of data protection, listed in the Privacy Policy attached to these terms and conditions and repeated by summary in art. 21 of these Terms and Conditions;

• Declares to have saved and/or printed a copy of the Privacy Policy and these Terms and Conditions;

• Fully, unequivocally and without reservation accepts the Terms and Conditions for the conclusion of the Contract fully, unequivocally and without reservation;

• Accepts fully, unequivocally and without reservation the Fee Schedule.

• Accepts the automatic collection of fees associated with the Service.

• Has entered all the required Registration Data.

4.4 Para completar o registo e utilizar o Serviço, o utilizador deve cumprir os requisitos mínimos estabelecidos nos presentes Termos e Condições e fornecer os dados obrigatórios para o Registo de Utilizador.

4.4 To complete the registration and use the Service, the user must meet the minimum requirements set out in these Terms and Conditions and provide the mandatory User Registration Data.

4.5 O procedimento de Registo está sujeito a confirmação posterior pela Empresa / LINK, que tem o direito de verificar a documentação fornecida pelo Utilizador junto das autoridades administrativas competentes.

4.5 The Registration procedure is subject to subsequent confirmation by the Company / LINK, which has the right to verify the documents provided by the User with the competent administrative authorities.

ARTIGO 5 - SISTEMA DE IDENTIFICAÇÃO

ARTICLE 5 - IDENTIFICATION SYSTEM

5.1 O sistema de identificação que, através da Conta, permite a celebração de um ou mais contratos e, portanto, a utilização do Serviço, é estritamente confidencial e pessoal para o Utilizador que acede através de login.

5.1 The identification system that, through the Account, allows the conclusion of one or more contracts and therefore the use of the Service, is strictly confidential and personal to the User who accesses it by login.

5.2 O Utilizador compromete-se a manter a sua conta segura e protegida.

5.2 The User undertakes to keep his account safe and secure.

5.3 O Utilizador será responsável pela segurança e sigilo do seu nome de utilizador e palavra-passe para aceder à Conta.

5.3 The User will be responsible for the security and secrecy of their username and password to access the Account.

5.4 Qualquer perda, dano, utilização não autorizada ou roubo da Conta deve ser imediatamente comunicado à Empresa através do Serviço ao Cliente.

5.4 Any loss, damage, unauthorised use or theft of the Account must be immediately reported to the Company via the Customer Service.

5.5 Em caso de violação dos compromissos no contrato, o Utilizador será responsável e deverá indemnizar ou isentar a Empresa / LINK de quaisquer danos e/ou prejuízos (incluindo indiretos como: multas e/ou sanções administrativas, designadamente de trânsito). Será igualmente responsável por todas as atividades que ocorram na sua conta, bem como em caso de roubo, perda, utilização não autorizada ou danos das trotinetes relacionadas com uma infração.

5.5 In case of breach of the commitments in the contract, the User will be liable and must indemnify or hold harmless the Company / LINK from any damages and/or losses (including indirect ones such as: fines and/or administrative penalties, notably traffic). You will also be liable for all activities that occur under your account, as well as in case of theft, loss, unauthorized use or damage of the scooters related to an infringement.

5.6 O Utilizador pode solicitar o cancelamento da Conta através do Serviço ao Cliente. Contudo o cancelamento não o desobriga do cumprimento de obrigações relativas ao serviço já utilizado.

5.6 The User may request the cancellation of the Account through Customer Service. However, cancellation does not release You from any obligations relating to the service already used.

ARTIGO 6 - PROCEDIMENTO DE ALUGUER E CELEBRAÇÃO DO CONTRATO

ARTICLE 6 - RENTAL PROCEDURE AND CONCLUSION OF THE CONTRACT

6.1 Para iniciar ou celebrar um Contrato, o Utilizador registado deve aceder à Aplicação através do seu Dispositivo e iniciar a trotinete utilizando o código QR ou o código indicado no código QR (para permitir o reconhecimento do Código) de acordo com as instruções dadas pela Empresa / LINK que consultar através da App e em link.city.

6.1 To start or enter into a Contract, the registered User must access the App through his/her Device and start the scooter using the QR code or the code indicated in the QR code (to enable Code recognition) according to the instructions given by the Company / LINK that you consult through the App and at link.city.

ARTIGO 7 - DISPONIBILIDADE DO SERVIÇO

ARTICLE 7 - SERVICE AVAILABILITY

7.1 O Utilizador reconhece que o Serviço está disponível na Área Operacional, identificada no Mapa, 7 dias por semana, exceto em casos de força maior, incluindo epidemias e pandemias ou decisões das autoridades competentes que impliquem restrições de qualquer tipo à utilização do Serviço.

7.1 The User acknowledges that the Service is available in the Operational Area, identified on the Map, 7 days a week, except in cases of force majeure, including epidemics or pandemics, or decisions by the competent authorities that imply restrictions of any kind on the use of the Service.

7.2 A Empresa não será responsável por quaisquer efeitos negativos ou consequências sofridas pelo Utilizador devido à indisponibilidade das trotinetes por motivos alheios à Empresa.

7.2 The Company will not be responsible for any negative effects or consequences suffered by the User due to the unavailability of the scooters for reasons beyond the Company's control.

7.3 A Empresa tomou todo o cuidado razoável na prestação dos Serviços.

7.3 The Company has taken all reasonable care in providing the Services.

7.4 O Utilizador reconhece que o Serviço pode estar sujeito a limitações e impedimentos fora do controlo da Empresa, tais como:

• O mau funcionamento da ligação à Internet do Utilizador

• A interrupção do Serviço devido a catástrofes naturais ou de força maior, incluindo epidemias ou pandemias, determinação legal designadamente por razões de política sanitária e medidas de recolhimento obrigatório;

• Danos causados à trotinete por terceiros;

7.4 The User acknowledges that the Service may be subject to limitations and impediments beyond the Company's control, such as:

• The malfunctioning of the User's Internet connection;

• Service interruption due to natural disasters or force majeure, including epidemics or pandemics, government legal determination namely for reasons of health policy and compulsory confinement measures;

• Damage caused to the scooter by third parties;

ARTIGO 8 – ACESSO E FIM DA UTILIZAÇÃO DA TROTINETE

ARTICLE 8 - ACCESS AND END OF THE SCOOTER RIDE

8.1 Para proceder ao início da viagem, o utilizador registado, após ler os termos e condições e política de privacidade, em caso de aceitação dos mesmos

• 1º Faz scan com o telemóvel do QR code que se encontra na trotinete,

• 2º A trotitene fica desbloqueada e pronta a ser usada

• 3º Procede à verificação de conformidade e não existindo problemas detetáveis, testa o sistema de travagem, guiador, pneus e dispositivo de aceleração da trotinete e inicia a marcha

• 4º A marcha ocorre a uma velocidade máxima de 25 Km por hora, estando o veículo dotado de um sistema limitador de velocidade que não permite que o próprio veículo gere uma potência superior a 500 Watt

8.1 To start the route, the registered user reads the terms and conditions and privacy policy. In case of acceptance of the same, the user:

• 1st: Scans the QR code on the scooter with his/her cell phone,

• 2nd: The scooter is unlocked and ready to be used,

• 3rd: Checks for conformity and if there are no detectable problems, tests the braking system, handlebars, tires and the scooter's acceleration device and starts the ride,

• 4th: The maximum speed is 25 km per hour. The vehicle is equipped with a speed limiter system that does not allow the vehicle to generate more than 500 watts of power.

8.2 Para terminar a viagem o utilizador vai à App e assinala o fim da viagem no campo identificado na App.

8.2 To end the trip the user signals in the App the end of the route in the identified field.

8.3 Tratando-se de Trotinetas sem doca, elas poderão ser estacionadas e encontradas em qualquer local onde é permitido para velocípedes. Para encontrar um trotineta disponível, basta consultar na App o mapa da área operacional e mantendo acessíveis os dados de geolocalização encontrará assinaladas as trotinetas disponíveis perto do utilizador.

8.3 Since these are dockless scooters, they may be parked and found at any location where it is allowed for bicycles or scooters. To find an available scooter nearby, users simply need the App with the map of the respective operational area, as well as the geolocation data accessible.

8.4 O período máximo de utilização em regime de sharing é de 24 horas

8.4 The maximum period for rental use is 24 hours.

ARTIGO 9 - CONTROLO PRELIMINAR DAS TROTINETES

ARTICLE 9 - PRELIMINARY CONTROL OF THE SCOOTERS

9.1 Embora as trotinetes estejam equipadas com as melhores tecnologias para a segurança do Utilizador, antes de utilizar a trotinete, o Utilizador deve sempre verificar cuidadosamente se a trotinete está livre de falhas, defeitos ou danos visíveis, e, para sua segurança, obriga-se a testar, antes de iniciar a utilização, o sistema de travagem, guiador, pneus e dispositivo de aceleração da trotinete.

9.1 Although the scooters are equipped with the best technologies for the safety of the User, before using the scooter, the User must always carefully check that the scooter is free of faults, defects or visible damage, and, for his/her own safety, undertakes to test the braking system, handlebars, tires and acceleration device of the scooter before starting to use it.

9.2 O Utilizador deve comunicar imediatamente à Empresa / LINK qualquer avaria, defeito ou dano da trotinete que tenha notado, na observação preliminar a que se obriga, através do Serviço de Apoio ao Cliente. O Utilizador está ciente, reconhece e aceita que, em caso de não o fazer, presume-se que o dano tenha sido causado pelo ao Utilizador que utilizou a trotinete naquele momento.

9.2 The User must immediately inform the Company / LINK of any malfunction, defect or damage to the scooter that it has noticed, in the preliminary observation that it is obliged to make through the Customer Service. The User is aware, acknowledges and accepts that, in the event that the User fails to do so, the damage will be presumed to have been caused by the User using the scooter at that time.

9.3 Em qualquer caso, é estritamente proibido fazer quaisquer modificações e/ou reparações na trotinete.

9.3 In any case, it is strictly forbidden to make any modifications and/or repairs to the scooter.

9.4 O Utilizador não responderá por falhas ou danos não reconhecíveis na trotinete.

9.4 The User will not be liable for faults or damage not recognizable on the scooter.

ARTIGO 10 - CONDIÇÕES DE UTILIZAÇÃO DA TROTINETE DURANTE A MARCHA
ARTICLE 10 - CONDITIONS OF USE OF THE SCOOTER DURING THE RIDE

10.1 Os utilizadores comprometem-se a utilizar a trotinete dentro da Área Operacional delimitada no Mapa e deverão circular em conformidade com as disposições regulamentares aplicáveis, ou seja, em plena conformidade com as disposições de: a) O Código da Estrada; b) Os regulamentos complementares; c) Os regulamentos locais aplicáveis.

10.1 Users undertake to use the scooter within the Operational Area delimited on the Map and must ride in compliance with the applicable regulatory provisions, i.e., in full compliance with the provisions of: a) The Highway Code; b) Additional regulations; c) Applicable local regulations.

10.2 Em particular, é de notar que os veículos abrangidos por estes Termos e Condições de Aluguer podem ser conduzidos: i) em estradas urbanas e ciclovias a uma velocidade não superior a 25 km/h, de acordo com a regulamentação aplicável. É proibida a circulação em pavimentos e zonas de peões.

10.2 In particular, it should be noted that the vehicles covered by these Rental Terms and Conditions may be driven: i) on urban roads and bicycle paths at a speed not exceeding 25 km/h, in accordance with the applicable regulations. Driving on sidewalks and pedestrian areas is forbidden.

10.3 Os utentes não podem exceder os limites de velocidade estabelecidos pela sinalização rodoviária e pela regulamentação aplicável. Para este efeito, a Empresa / LINK garante que as trotinetes estão equipados com um limitador de velocidade que não permite que o próprio veículo gere uma potência superior a 500 Watt.

10.3 Users may not exceed the speed limits established by road signs and applicable regulations. For this purpose, the Company / LINK ensures that the scooters are equipped with a speed limiter that does not allow the vehicle itself to generate a power exceeding 500 watts.

10.4 Em todo o caso, é proibido conduzir em auto-estradas e estradas com duas faixas de rodagem (mesmo as que circulam dentro da cidade), estradas interurbanas, travessias, túneis urbanos, bem como zonas pedonais e calçadas. Também é proibido andar em áreas urbanas caracterizadas por pedras de calçada, tanto por razões de segurança para os utilizadores como para evitar possíveis danos na trotinete. Também é proibido o transporte de outras pessoas.

10.4 In any case, it is prohibited to drive on freeways and dual carriageway roads (even those running within the city), interurban roads, crossings, urban tunnels, as well as pedestrian areas and sidewalks. Riding in urban areas characterized by cobblestones is also prohibited, both for safety reasons for users and to avoid possible damage to the scooter. Transporting other people is also prohibited.

10.5 Os utilizadores, enquanto utilizam as trotinetes, devem sempre evitar saltos bruscos ou movimentos em zig-zag, que podem constituir um obstáculo ou perigo para outros veículos ou peões.

10.5 Users, while using scooters, should always avoid sudden jumps or zig-zag movements, which may pose an obstacle or danger to other vehicles or pedestrians.

10.6 No caso de atravessar estradas com tráfego particularmente intenso e, em geral, quando as circunstâncias o exigirem, o Utilizador deve atravessar tomando o veículo na mão, bem como nas proximidades de passagens de peões.

10.6 In the case of crossing roads with particularly heavy traffic and, in general, when circumstances require it, the User should cross by taking the vehicle in hand, as well as near pedestrian crossings.

10.7 As trotinetes são concebidas para utilização de pé pelos utilizadores, um só utilizador de cada vez, e não podem ser equipadas com um assento.

10.7. The scooters are designed for standing use by users, only one user at a time, and cannot be equipped with a seat.

10.8 Quando os Utilizadores andam com as suas trotinetes nas pistas para bicicletas, devem adaptar o seu comportamento de acordo com as disposições dos regulamentos aplicáveis.

10.8 When Users ride their scooters on bike lanes, they must adapt their behaviour according to the provisions of the applicable regulations.

10.9 A utilização de um capacete de proteção pelo utilizador é sempre recomendada. O capacete de proteção deve ser usado quando exigido pelos regulamentos aplicáveis e pode ser condição para efeitos de cobertura de seguro de acidentes pessoais, conforme informação sobre coberturas e exclusão nestes Termos e Condições.

10.9 The use of a helmet by the user is always recommended. The helmet must be worn when required by applicable regulations and may be a condition of personal accident insurance coverage, as per the coverage and exclusion information in these Terms and Conditions.

10.10 As sanções previstas no Código da Estrada são aplicáveis aos Utilizadores. Se enviada qualquer notificação com aplicação de sanções à Empresa, esta cobrará do Utilizador a sanção que lhe for aplicada correspondente ao período em que estiver na posse, uso ou sob responsabilidade do Utilizador caso não a estando a usar, não a tenha devolvido ou estacionado em local adequado.

10.10 The sanctions foreseen in the Highway Code are applicable to Users. If any notification with the application of sanctions is sent to the Company, the Company will charge the User the sanction that is applied corresponding to the period that it is in the possession, use or under the responsibility of the User if they are not using it, have not returned it or have not parked it in an appropriate place.

10.11 Os utilizadores comprometem-se a utilizar a trotinete dentro da Área Operacional, em infra-estruturas rodoviárias e/ou partes da estrada, identificadas e de acordo com as disposições da legislação em vigor, com especial referência às disposições do Código da Estrada e outros regulamentos aplicáveis.

10.11 Users undertake to use the scooter within the Operational Area, on road infrastructure and/or parts of the road, identified and in accordance with the provisions of the legislation in force, with particular reference to the provisions of the Highway Code and other applicable regulations.

10.12 Os utilizadores comprometem-se a utilizar a trotinete com o cuidado e diligência, observando escrupulosamente a legislação e, em particular, relativa à circulação rodoviária, evitando cuidadosamente atropelar qualquer peão, bem como causar qualquer perigo que possa causar colisões com veículos (por exemplo, ao atravessar estradas ou quando há veículos estacionados).

10.12 Users undertake to use the scooter with care and diligence, scrupulously observing the law and, in particular, regarding road traffic, carefully avoiding collision with any pedestrians, as well as causing any danger that could lead to collisions with vehicles (for example, when crossing roads or when there are parked vehicles).

10.13 O Utilizador concorda em utilizar a trotinete em conformidade com as disposições da página específica indicada pela Superpedestrian / LINK. Após o estacionamento, e antes de deixar a trotinete, o Utilizador deve certificar-se de que esta se encontra estacionada de acordo com as disposições na Área Operacional, de acordo com o Regulamento (por exemplo, em áreas a não obstruir o tráfego de peões ou veículos) e verificar se está bloqueada. O Utilizador deverá conduzir durante o Período de Aluguer de acordo com a Lei e de uma forma segura para si e para os outros.

10.13 The User agrees to use the scooter in accordance with the provisions of the specific website or app page indicated by Superpedestrian / LINK. After parking, and before leaving the scooter, the User must ensure that it is parked in accordance with the provisions in the Operational Area, in accordance with the Regulations (for example in areas not obstructing pedestrian or vehicular traffic) and check that it is locked. You must drive during the Rental Period in accordance with the Law and in a way that is safe for you and others.

10.14 Se o Utilizador utilizar a trotinete fora da Área Operacional da cidade onde teve início o Período de Aluguer, a Empresa pode cobrar ao Cliente, a título de adiantamento, a soma de 10,00 euros por exceder o limite exterior da Área Operacional.

10.14 If the User uses the scooter outside the Operational Area of the city where the Rental Period began, the Company may charge the Customer, as an advance payment, the sum of €10.00 for exceeding the outside limit of the Operational Area.

10.15 Se o cartão de crédito ou cartão pré-pago, conforme o caso, registado pelo Cliente rejeitar um débito, a Empresa procederá a novas tentativas de débito e, no caso de não haver débito ou débito rejeitado, a Empresa notificará o Cliente do não pagamento, reservando-se o direito de suspender o Cliente do Serviço até que as dívidas tenham sido liquidadas.

10.15 If the credit card or prepaid card, as the case may be, registered by the Customer rejects a debit, the Company will make further debit attempts and, in the event of no debit or rejected debit, the Company will notify the Customer of the non-payment and reserves the right to suspend the Customer from the Service until the debts have been settled

10.16 Em caso de atraso após um aviso expresso da Empresa para devolver a trotinete, será cobrada ao Cliente uma penalização por cada hora de atraso de acordo com a tabela apresentada no Anexo 1, no cumprimento do pedido de devolução, exceto no caso de suspensão e/ou rescisão do Contrato por violação grave por parte do Cliente.

10.16 In case of delay after an express notice from the Company to return the scooter, the Customer will be charged a penalty for each hour of delay according to the table set forth below under the heading Appendix 1, in compliance with the return request, except in case of suspension and/or termination of the Contract for serious breach by the Customer.

10.17 É proibido ao Utilizador utilizar a trotinete para práticas que ponham em causa a vida, saúde, e segurança do Utilizador e de Terceiros, designadamente:

• Conduzir a trotinete de uma forma que cause ou possa causar ferimentos, desconforto ou imprudência a outros;

• Para o transporte de mercadorias ou pessoas em contravenção aos regulamentos;

• Para corridas ou competições de velocidade;

• Para o transporte de animais;

• Para realizar um serviço de aluguer a terceiros, ou para qualquer outro fim comercial na medida em que Terceiros não conhecem os termos e condições da utilização do Serviço, incluindo quanto às normas de segurança e não deram expressamente o consentimento aos termos e condições e usos de dados pessoais;

• Cometer delitos civis, criminais ou administrativos;

• Praticar atos contrários à ordem pública e aos regulamentos de segurança pública;

• Para transportar substâncias perigosas, inflamáveis, tóxicas ou similares;

• Transportar armas, explosivos, radioativos, bacteriológicos e similares;

• Para transportar objetos com uma forma, tamanho ou peso que ponham em perigo o funcionamento seguro da trotinete ou danifiquem partes da trotinete, peões, veículos ou outros bens de terceiros;

• Usar a trotinete como reboque.

10.17 It is prohibited for the User to use the scooter for practices that endanger the life, health, and safety of the User and Third Parties, namely:

• To drive the scooter in a manner that causes or may cause injury, discomfort, or recklessness to others;

• To transport goods or persons in contravention of regulations;

• For racing or speed competitions;

• For the transportation of animals;

• To carry out a rental service for third parties, or for any other commercial purpose to the extent that Third Parties are not aware of the terms and conditions of use of the Service, including as to safety standards and have not expressly consented to the terms and conditions and uses of personal data;

• Committing civil, criminal or administrative offenses;

• To practice acts contrary to public order and public safety regulations;

• To transport dangerous, flammable, toxic or similar substances;

• To transport weapons, explosives, radioactive, bacteriological and similar;

• To transport objects of a shape, size or weight that endanger the safe operation of the scooter or damage parts of the scooter, pedestrians, vehicles or other property of third parties;

• To use the scooter as a trailer.

10.18 O Utilizador não deve:

• Conduzir a trotinete para fora da Área Operacional;

• Transportar a trotinete em veículos privados;

• Sujar, danificar ou deformar a trotinete;

• Utilizar a trotinete em caso de vento forte ou mau tempo, inundações, terramotos, etc..;

• Desmontar, adulterar a trotinete ou realizar ou permitir a realização de quaisquer reparações ou modificações na trotinete;

• Deixar a trotinete sem vigilância;

• Apagar quaisquer marcas comerciais, nomes de marcas ou outros sinais distintivos da trotinete;

• Divulgar qualquer publicidade comercial ou não comercial na trotinete ou na App, sem consentimento prévio por escrito;

• Infringir quaisquer direitos legítimos de terceiros

10.18 The User must not:

• Drive the scooter outside the Operational Area;

• Transport the scooter in private vehicles;

• Dirty, damage or deform the scooter;

• Use the scooter in case of strong wind or bad weather, floods, earthquakes, etc;

• Dismantle, tamper with the scooter or carry out or allow any repairs or modifications to be carried out on the scooter;

• Leave the scooter unattended;

• Erase any trademarks, brand names or other distinctive signs from the scooter;

• Disclose any commercial or non-commercial advertising on the scooter or App, without prior written consent;

• Infringe any legitimate rights of third parties

10.19 A Empresa reserva-se o direito de tomar medidas contra o Utilizador no caso do Utilizador ter perpetrado ou ajudado e instigado o roubo da trotinete através de conduta dolosa, deliberada, negligente ou imprudente, cobrando ao Utilizador uma quantia igual ao valor da trotinete.

10.19 The Company reserves the right to take action against the User in the event that the User has perpetrated or aided and abetted the theft of the scooter through wilful, deliberate, negligent or reckless conduct, charging the User an amount equal to the value of the scooter.

10.20 Quaisquer sanções impostas pelas autoridades competentes pela utilização da trotinete pelo não cumprimento dos Regulamentos pelo Utilizador serão inteiramente suportadas pelo Utilizador. Qualquer penalidade, multa, taxa, danos reclamados por Entidade Pública devido à utilização ou mau uso da trotinete, poderão ser transmitidos ao Utilizador pela Superpedestrian mediante comprovação de que foram causados pelo Utilizador, sem prejuízo do direito de oposição do Utilizador, mediante prova em sentido contrário. De igual modo no que respeita a danos reclamados por terceiros e comprovadamente causados por ato ou omissão da diligência exigível pelo Utilizador, sem prejuízo do direito de oposição do Utilizador, mediante prova em sentido contrário.

10.20 Any sanctions imposed by the competent authorities for the use of the scooter for the User's non-compliance with the Regulations will be borne entirely by the User. Any penalties, fines, fees, damages claimed by a Public Entity due to the use or misuse of the scooter may be transmitted to the User by Superpedestrian upon proof that they were caused by the User, without prejudice to the User's right to object upon proof to the contrary. Likewise with regard to damages claimed by third parties and proven to have been caused by an act or omission of diligence required by the User, without prejudice to the User's right to object, upon proof to the contrary.

10.21 Os utilizadores devem estacionar as trotinetes em áreas permitidas para o efeito. Estacionar num local não permitido determinará que a Superpedestrian poderá reclamar do Utilizador as penalidades, taxas, preços públicos ou similares que sejam impostos devido a tal estacionamento num local não permitido, sem prejuízo do direito de oposição do Utilizador, mediante prova em sentido contrário.

10.21 Users must park their scooters in areas permitted for that purpose. Parking in a non-permitted place will determine that Superpedestrian may claim from the User the penalties, fees, public prices or similar that are imposed due to such parking in a non-permitted place, without prejudice to the User's right to object, upon proof to the contrary.

10.22 Em caso de violação destes Termos e Condições, a Empresa terá o direito de rescindir o presente Contrato sem aviso prévio, por violação do contrato por parte do Utilizador, bloqueando imediatamente a trotinete, sem prejuízo de intentar ação de indemnização ou outra ação legal para a defesa dos seus interesses perante os Tribunais competentes.

10.22. In the event of a breach of these Terms and Conditions, the Company shall be entitled to terminate this Agreement without prior notice, for breach of contract by the User, immediately blocking the scooter, without prejudice to bringing an action for damages or other legal action to defend its interests before the competent Courts.

ARTIGO 11 - CARREGAMENTO DA TROTINETE

ARTICLE 11 – CHARGING THE SCOOTER

11.1 A trotinete não pode ser alugada se o nível de carga da bateria da trotinete não for suficiente para a prestação do Serviço.

11.1 The scooter cannot be rented if the charge level of the scooter battery is not sufficient to provide the Service.

11.2 Se durante o período de aluguer, o nível de carga da bateria da trotinete, para além do resultado do indicador no volante, descer abaixo dos 10%, o Utilizador deverá terminar o Aluguer da trotinete. Caso contrário, a Empresa / LINK reserva-se o direito de a bloquear por razões de segurança.

11.2 If during the rental period, the charge level of the scooter battery, in addition to the result of the indicator on the steering wheel, falls below 10%, the User must terminate the Rental of the scooter. Otherwise, the Company / LINK reserves the right to lock the scooter for safety reasons.

ARTIGO 12 - RESPONSABILIDADE DA EMPRESA e do UTILIZADOR

ARTICLE 12 - COMPANY AND USER RESPONSIBILITY

12.1 A Empresa só é responsável perante o Utilizador por danos diretos, típicos desde que sejam causados voluntariamente ou por negligência da própria Empresa.

12.1 The Company is only liable to the User for direct, typical damage provided that it is caused intentionally or through the Company's own negligence.

12.2 A Empresa não é responsável se a violação destes Termos e Condições for devida a força maior, à ação de um terceiro ou a qualquer razão fora do seu controlo.

12.2 The Company is not liable if the violation of these Terms and Conditions is due to force majeure, the action of a third party or any reason beyond its control.

12.3 A responsabilidade por danos a pessoas ou bens do Utilizador e/ou de terceiros, durante a utilização da trotinete, cabe exclusivamente ao Utilizador, bem como por qualquer dano, dano ou perda resultante do incumprimento das obrigações estabelecidas nos Termos e Condições ou na legislação aplicável.

12.3 Responsibility for damage to persons or property of the User and/or third parties during use of the scooter lies solely with the User, as well as for any damage, injury or loss resulting from failure to comply with the obligations set out in the Terms and Conditions or applicable law.

12.4 O Utilizador é o único responsável pela utilização do Serviço, nomeadamente: a) Pelo acesso à sua Conta de Utilizador e pela utilização do serviço através das suas credenciais de acesso; b) Pelas operações, incluindo pagamento, efetuados através da Conta de Utilizador c) Por qualquer extravio, furto ou roubo ou dano causado à Empresa enquanto a trotinete não for devolvida, sem prejuízo da responsabilidade civil, contraordenacional e / ou criminal que possa vir a ser imputada a Terceiros e sem prejuízo do direito de oposição do Utilizador.

12.4 The User is solely responsible for the use of the Service, namely: a) for accessing their User Account and using the Service through their access credentials; b) Operations, including payment, carried out through the User Account c) For any loss, theft or damage caused to the Company while the scooter is not returned, without prejudice to civil, administrative and/or criminal liability that may be attributed to third parties and without prejudice to the User's right to object.

12.5 A existência de Seguro não exclui a responsabilidade civil, penal ou contraordenacional que possa vir a ser imputada ao Utilizador por danos causados à Empresa ou a Terceiros decorrentes, designadamente de conduta ilícita, culposa, negligente ou dolosa.

12.5 The existence of Insurance does not exclude civil, criminal or administrative liability that may be attributed to the User for damages caused to the Company or Third Parties resulting, namely, from illicit, culpable, negligent or wilful conduct.

12.6 O Utilizador é o único responsável por garantir a segurança dos equipamento utilizados para acesso à App do Serviço, bem como por garantir a confidencialidade dos Dados de acesso à Conta de Utilizador.

12.6 The User is solely responsible for ensuring the security of the equipment used to access the Service App, as well as for guaranteeing the confidentiality of the User Account Access Data.

12.7 O Utilizador permanece vinculado aos dados que fornecer durante e / ou após o Registo de Utilizador e é permanentemente responsável pela sua veracidade, exatidão, atualidade e autenticidade, podendo retifica-los a todo o tempo.

12.7 The User remains bound by the data he provides during and/or after the User Registration and is permanently responsible for its truthfulness, accuracy, currency and authenticity, being able to rectify them at any time.

ARTIGO 13 – SEGUROS

ARTICLE 13 - INSURANCE

13.1 A Empresa declara que está coberta por uma apólice de seguro de responsabilidade de terceiros contra a responsabilidade da Empresa por danos a terceiros ou danos acidentais à propriedade de terceiros decorrentes do uso de uma Scooter.

13.1 The Company declares that it is covered by a third-party liability insurance policy against Company liability for injury to third parties or accidental damage to third-party property arising from the use of a Scooter.

13.2 A empresa oferece seguro de responsabilidade do utilizador por lesões ou danos materiais, de acordo com os termos e limitações das apólices de seguro. Consulte os detalhes das apólices de seguro na nossa página de seguros em link.city/terms-and-conditions/insurance. Sem prejuízo da leitura obrigatória das apólices publicitadas, que se presume com a subscrição dos presentes Termos e Condições os seguros disponibilizados tem as seguintes coberturas:

I) Seguro de Responsabilidade Civil Geral:

A apólice do seguro de Responsabilidade Civil Geral garante as indemnizações que possam legalmente recair sobre os Segurados por responsabilidade civil resultante de:

Danos Corporais a terceiros resultantes diretamente de um acidente de viação e/ou

Danos Patrimoniais a terceiros resultantes diretamente de um acidente de viação e/ou

Custos de Defesa resultantes diretamente de um acidente de viação (é necessário o prévio consentimento escrito do Segurador)

Capital seguro

1 000 000 EUR por sinistro e 3 000 000 EUR por anuidade (primeira anuidade ou período contratual de 1 de Novembro de 2021 a 31 de Dezembro de 2022 e as seguintes de 1 de janeiro a 31 de dezembro de cada ano)

II) Seguro de Acidentes Pessoais:

Incapacidade Parcial ou Total Permanente causada por acidente de viação: Montante fixo €50,000 e montante determinado pelo grau de deficiência (taxa determinada pelo grau de deficiência e acima do limiar mínimo de 15% de deficiência resultante de um acidente de viação).

Morte causada por acidente de viação: Montante em capital até €50,000.

13.2 The company provides insurance against your liability for injury or property damage in accordance with the terms and limitations of the insurance policies. Please refer to the details of the insurance policies on our insurance page at link.city/terms-and-conditions/insurance. Without prejudice to the compulsory reading of the advertised policies, which is assumed with the subscription of these Terms and Conditions the insurance provided has the following covers:

I) General Civil Liability Insurance:

The General Liability insurance policy guarantees the indemnities that may legally fall upon the Beneficiaries for civil liability resulting from:

1. Bodily Injury to third parties resulting directly from a road traffic accident and/or

2. Damage to Property to third parties as a direct result of a road traffic accident and/or

3. Defence Costs resulting directly from a road traffic accident (prior written consent of the Insurer is required)

Sum Insured

1. 1.000.000 EUR per claim and 3.000.000 EUR per annuity (first annuity or contractual period from 1st November 2021 to 31st December 2022 and the following ones from 1st January to 31st December of each year)

II) Personal Accident Insurance:

1. Partial or Total Permanent Disability caused by a road traffic accident: Fixed amount €50,000 and amount determined by the degree of disability(rate determined by the degree of disability and above the minimum threshold of 15% disability resulting from a road traffic accident).

2.Death caused by a road traffic accident: lump sum of up to €50,000..

ARTIGO 14 - OBRIGAÇÕES EM CASO DE DEFEITO, ACIDENTE, DANO, AGRESSÃO OU ROUBO

ARTICLE 14 - OBLIGATIONS IN CASE OF DEFECT, ACCIDENT, DAMAGE, AGGRESSION OR THEFT

14.1 Em caso de acidente envolvendo a trotinete, ou em caso de danos ou ferimentos a um bem ou pessoa em resultado da sua utilização, o Utilizador deve: Parar o Aluguer logo que possível numa área segura; Contactar a Empresa através do Serviço de Atendimento ao Cliente para comunicar o acidente/dano/agressão, fornecer todas as informações necessárias solicitadas pela Empresa; Comunicar o acidente/dano/agressão à Polícia e/ou outra Autoridade de Segurança Pública, independentemente de o Utilizador acreditar que foi causado pela sua própria conduta ou pela de um terceiro; Permanecer no local do acidente / danos / ferimentos até ao momento em que:

• Verifica que todas as pessoas envolvidas não foram feridas e, em caso de ferimento, até à chegada da assistência médica;

• Chega a polícia e/ou outras Autoridades de Segurança Pública ao local do acidente e fazem um relatório;

• A trotinete estacionada em segurança ou levada para outro local por entidade autorizada;

• Fica com os dados pessoais, matrículas de veículos e outros dados estritamente necessários para contactar todos os veículos e pessoas envolvidas, incluindo testemunhas, bem como uma cópia do relatório elaborado pelas Autoridades.

14.1 In case of an accident involving the scooter, or in case of damage or injury to a property or person as a result of its use, the User shall: Stop the Rental as soon as possible in a safe area; Contact the Company through Customer Service to report the accident/damage/injury, provide all necessary information requested by the Company; Report the accident/damage/aggression to the Police and/or other Public Safety Authority, regardless of whether the User believes it was caused by his/her own conduct or that of a third party; Remain at the scene of the accident / damage / injury until such time as:

• Verifies that all persons involved have not been injured and, in the event of injury, until medical assistance arrives;

• Police and/or other Public Safety Authorities arrive at the accident scene and make a report;

• The scooter is parked safely or taken to another location by an authorized entity;

• The User must collect and keep personal data, vehicle license plates and other data strictly necessary to contact all vehicles and people involved, including witnesses, as well as a copy of the report drawn up by the Authorities.

14.2 No caso de o Utilizador não ter cumprido sequer uma das tarefas indicadas nos pontos anteriores, a Empresa terá o direito de rescindir o Contrato, devido ao não cumprimento das suas obrigações.

14.2 In the case the User has not fulfilled even one of the tasks indicated in the previous points, the Company and will have the right to terminate the Contract, due to non-compliance with its obligations.

14.3 Em caso de acidente, o acordo não será considerado terminado até que a trotinete seja devidamente devolvida em conformidade com os presentes Termos e Condições. Dependendo dos danos causados à trotinete, a Empresa pode cobrar ao Utilizador até um montante máximo de 500,00 euros, sem prejuízo do direito de oposição legal do Utilizador.

14.3 In the event of an accident, the agreement will not be considered terminated until the scooter is duly returned in accordance with these Terms and Conditions. Depending on the damage caused to the scooter, the Company may charge the User up to a maximum amount of €500.00, without prejudice to the User's right of legal objection.

14.4. Em caso de perda ou roubo de uma trotinete durante a sua utilização, o Utilizador deverá comunicar o incidente ao Serviço de Atendimento ao Cliente. A Empresa pode cobrar ao Utilizador a soma de 500,00 euros, mas o utilizador tem o direito de contestar caso a culpa não seja do utilizador.

14.4 If a scooter is lost or stolen during use, the User must report the incident to Customer Services. The Company may charge the User the sum of €500.00, but the User has the right to contest if the User is not at fault.

14.5 Em caso de roubo ou vandalismo que cause danos à trotinete durante a sua utilização por um Utilizador, este último deve comunicá-lo imediatamente, à polícia e transmitir à Empresa o respetivo número de denúncia ou protocolo fornecido pela polícia ao fazer a denúncia contactando imediatamente.

14.5 In the event of theft or vandalism causing damage to the scooter during its use by a User, the latter must report it immediately to the police and provide the Company with the respective complaint number or protocol provided by the police when making the report by contacting them immediately.

ARTIGO 15 - DURAÇÃO DO CONTRATO

ARTICLE 15 - CONTRACT DURATION

15.1 O Contrato terminará automaticamente quando o Utilizador tiver devolvido a trotinete e deverá cumprir todos os requisitos seguintes: Concluir o contrato através da aplicação LINK; Assegurar que a trotinete está trancada; Estacionar dentro da Área Operacional num parque de estacionamento público adequado para os fins dos Regulamentos e/ou regras aplicáveis.

15.1 The Contract will automatically end when the User has returned the scooter and must meet all of the following requirements: Conclude the contract via the LINK application; Ensure that the scooter is locked; Park within the Operational Area in a suitable public parking lot for the purposes of the Regulations and/or applicable rules.

15.2 Em nenhuma circunstância é permitido ao Utilizador celebrar o Contrato estacionando a trotinete como um obstáculo para peões ou veículos, especialmente em áreas onde o estacionamento ou paragem é proibido, ou em locais não acessíveis à Empresa e/ou outros Utilizadores, nem em qualquer lugar fora da Área Operacional. Nesse caso as penalidades administrativas bem como custos incorridos pela Empresa para a recuperação e/ou remoção da trotinete serão inteiramente suportados pelo Utilizador. Além disso, é expressamente proibido estacionar a trotinete em semáforos ou sinais de trânsito, em máquinas de venda automática de bilhetes ou parquímetros, em pavimentos assim reduzidos a uma largura inferior a 1,5 metros, e em frente ou perto de saídas de emergência ou saídas de incêndio, bem como em qualquer outro local onde o Código da Estrada proíba a paragem ou o estacionamento. O Utilizador reembolsará a Empresa por quaisquer despesas, multas ou outros custos necessários em caso de violação desta proibição.

15.2 Under no circumstances is the User permitted to conclude the Contract by parking the scooter as an obstacle to pedestrians or vehicles, especially in areas where parking or stopping is prohibited, or in places not accessible to the Company and/or other Users, nor in any place outside the Operational Area. In this case administrative penalties as well as costs incurred by the Company for the recovery and/or removal of the scooter will be borne entirely by the User. Furthermore, it is expressly forbidden to park the scooter at traffic lights or traffic signals, at ticket vending machines or parking meters, on sidewalks thus reduced to a width of less than 1.5 meters, and in front of or near emergency exits or fire exits, as well as in any other place where the Highway Code prohibits stopping or parking. You will reimburse the Company for any expenses, fines or other costs necessary in the event of a breach of this prohibition.

15.3 Se, devido a uma má ou ausente ligação do Dispositivo, não for possível concluir o Aluguer, o Utilizador deverá estacionar a trotinete num outro local e repetir a operação. Se o Utilizador abandona a trotinete sem ter rescindido o Contrato, o Contrato continuará com a consequente cobrança dos montantes correspondentes ao abrigo da Tabela de Taxas apresentada no Anexo 1.

15.3 If, due to a bad or missing Device connection, it is not possible to complete the Rental, the User must park the scooter in another location and repeat the operation. If the User leaves the scooter without having terminated the Contract, the Contract will continue with the consequent collection of the corresponding amounts under the Fees Table indicated below under the heading Appendix 1.

15.4 Se o Acordo não puder ser celebrado por razões técnicas, o Utilizador é obrigado a contactar imediatamente o Serviço de Atendimento ao Cliente.

15.4 If the Agreement cannot be concluded for technical reasons, the User is obliged to contact Customer Service immediately.

15.5 O período máximo de utilização é de 24 horas.

15.5 The maximum period of use is 24 hours.

ARTIGO 16 - CONDIÇÕES FINANCEIRAS

ARTICLE 16 - FINANCIAL CONDITIONS

16.1 O Serviço oferecido é calculado como especificado na Tabela de Preços no Anexo1: taxa de início do serviço e taxa por "minuto", calculada com base na hora de cada Aluguer individual. Os minutos parcialmente utilizados serão arredondados para 60 (sessenta) segundos a partir dos trinta e um segundos.

16.1 The Service offered is calculated as specified in the Price List set forth below under the heading Appendix 1: service start fee and fee per "minute", calculated on an hourly basis for each individual Rental. Partially used minutes will be rounded up to sixty (60) seconds from thirty-one seconds.

16.2 Se os fundos disponíveis na Conta do Utilizador para o Aluguer forem insuficientes, o saldo restante será debitado assim que os fundos forem adicionados à Conta. O Utilizador não poderá iniciar um novo Aluguer enquanto não houver fundos suficientes disponíveis na Conta.

16.2 If there are insufficient funds available in the User's Account for the Rental, the remaining balance will be debited as soon as funds are added to the Account. You may not start a new Rental until there are sufficient funds available in the Account.

16.3 Se o Utilizador desejar reclamar um montante cobrado, deve contactar o Serviço de Apoio ao Cliente no prazo de 90 dias por e-mail: support@link.city.

16.3 If the User wishes to reclaim an amount charged, the User must contact Customer Service within 90 days by e-mail: support@link.city.

16.5 São aceites como meios de pagamento Cartão de Crédito e Cartão de Débito. O Utilizador autoriza a Empresa / LINK a cobrar o montante do Serviço correspondente ao Plano de Tarifas no Cartão de Crédito ou Cartão de Débito fornecido no momento da inscrição na Aplicação.

16.5 Credit Card and Debit Card are accepted as means of payment. The User authorizes the Company / LINK to charge the amount of the Service corresponding to the Rate Plan on the Credit Card or Debit Card provided at the time of registration in the Application.

16.6 Ao critério exclusivo da Superpedestrian, a Superpedestrian pode oferecer créditos que podem ser adicionados à carteira da conta do Utilizador. Estes créditos (i) devem ser utilizados apenas para pagar os serviços contratados através da App (ii) não podem ser vendidos (iii) não podem de forma alguma ser considerados dinheiro eletrónico ou propriedade pessoal do Utilizador (iv) não terão qualquer valor em dinheiro e não podem ser resgatados (v) como bónus, podem ser cancelados pela Superpedestrian em qualquer altura por decisão unilateral (vi) não podem de forma alguma ser pagos ou reembolsados no final do contrato.

16.6 At Superpedestrian's sole discretion, Superpedestrian may offer credits that may be added to the User's account wallet. These credits (i) must be used only to pay for the services contracted through the App (ii) cannot be sold (iii) cannot in any way be considered electronic money or personal property of the User (iv) shall have no cash value and cannot be redeemed (v) as a bonus, may be cancelled by Superpedestrian at any time by unilateral decision (vi) cannot in any way be paid or refunded at the end of the contract.

ARTIGO 17 - INTERVENÇÃO DO PESSOAL TÉCNICO DA EMPRESA

ARTICLE 17 - INTERVENTION OF THE COMPANY'S TECHNICAL STAFF

17.1 Caso a Empresa, tenha que solicitar a intervenção e / ou assistência de pessoal técnico, devido a atuação ou omissão do Utilizador na utilização das trotinetes em incumprimento destes Termos e Condições e/ou os regulamentos, deverá reembolsar à Empresa o custo da mesma, devidamente comprovado, sem prejuízo do direito de oposição com prova em sentido contrário.

17.1 If the Company has to request the intervention and/or assistance of technical staff, due to the User's action or omission in the use of the scooters in breach of these Terms and Conditions and/or the regulations, he/she must reimburse the Company the cost of the same, duly proven, without prejudice to the right to object with proof to the contrary.

ARTIGO 18 - ALTERAÇÕES AOS TERMOS E CONDIÇÕES

ARTICLE 18 - CHANGES TO THE TERMS AND CONDITIONS

18.1 A Empresa tem o direito de modificar estes Termos e Condições e o Plano Tarifário para futuros Contratos devido à evolução tecnológica ou de segurança das trotinetes e/ou da App, ou às condições económicas do mercado, ou à entrada em vigor de novos regulamentos. As alterações serão comunicadas ao Utilizador através de publicação na Aplicação, salvaguardando-se os direitos do Utilizador nos termos do nº seguinte.

18.1 The Company has the right to modify these Terms and Conditions and the Tariff Plan for future Contracts due to technological or safety developments of the scooters and/or the App, or to the economic conditions of the market, or to the entry into force of new regulations. Changes will be communicated to the User by publishing them in the Application, safeguarding the User's rights under the following paragraph.

18.2 Em caso de qualquer modificação dos termos e condições contratuais, o Utilizador terá o direito de rescindir o Contrato no prazo de 15 dias sem quaisquer custos ou penalizações. O período de retirada é calculado a partir da publicação das alterações no Pedido. Uma vez decorrido este período sem que a Empresa tenha sido notificada por escrito da rescisão, a modificação será considerada tacitamente aceite pelo Utilizador e, portanto, acordada entre as partes do Contrato.

18.2 In the event of any modification of the contractual terms and conditions, the User has the right to withdraw from the Contract within 15 days without any costs or penalties. The withdrawal period is calculated from the publication of the changes in the Order. Once this period has elapsed without the Company has been notified in writing of the withdrawal, the modification shall be considered tacitly accepted by the User and therefore agreed between the parties to the Contract.

ARTIGO 19 - DIREITO DE RESCISÃO, SUSPENSÃO DO SERVIÇO E RESCISÃO DO CONTRATO

ARTICLE 19 - RIGHT OF WITHDRAWAL, SUSPENSION OF SERVICE AND TERMINATION OF CONTRACT

19.1 O Utilizador pode rescindir o Contrato com a Empresa a qualquer momento através de notificação à Empresa, com 15 (quinze) dias de antecedência, por e-mail enviado do endereço de e-mail registado na Aplicação.

19.1 The User may terminate the Agreement with the Company at any time by giving fifteen (15) days notice to the Company by e-mail sent from the e-mail address registered in the Application.

19.2 A Empresa pode, a qualquer momento, desistir do Contrato mediante notificação por escrito ao Utilizador mediante envio de notificação via aplicação com 15 (quinze) dias de antecedência, devolvendo ao Utilizador, fundos que tenha em Carteira.

19.2 The Company may, at any time, withdraw from the Contract by notifying the User by notification via app with fifteen (15) days' notice, returning to the User, funds held in the Wallet.

19.3 A Empresa pode suspender, em qualquer altura e sem aviso prévio, o Serviço, notificando o Utilizador mediante notificação via aplicação se detetar violações dos Termos e Condições ou dos Regulamentos.

19.3 The Company may suspend, at any time and without prior notice, the User’s account by notifying the User via app notification if it detects violations of the Terms and Conditions or the Regulations.

19.4 A Empresa pode rescindir o Contrato existente com o Utilizador por violação do contrato pelo Utilizador e sem opção de indemnização por danos adicionais, nos casos abaixo indicados, bem como, em todos os outros casos em que este direito esteja previsto nos presentes Termos e Condições:

• Falha e/ou atraso no pagamento de montantes devidos ao abrigo do Plano Tarifário ou ao abrigo dos presentes Termos e Condições;

• Imprecisão e falta de fiabilidade das informações fornecidas à Empresa através do pedido LINK durante o registo ou posteriormente, incluindo a criação de múltiplas contas por uma só pessoa para abuso da utilização de códigos promocionais, créditos ou outros descontos, ou evitar o cumprimento dos Termos & Condições;

• Se o Utilizador for sancionado, ou tiver comprovadamente conduzido, sob efeito de álcool, drogas ou outras substâncias psicotrópicas;

• Não devolução de uma trotinete ou se esta for conduzida por uma pessoa que não seja o Utilizador;

• Facilitação ou comissão negligente ou intencional pelo Utilizador de roubo, vandalismo em detrimento de uma ou mais trotinetes;

• Se o Utilizador incorrer em sanções por violação do Código da Estrada ou dos regulamentos aplicáveis;

• Se o Utilizador, por uma causa que lhe seja imputável, tiver causado um acidente com um peão ou veículo ou com danos na trotinete.

19.4 The Company may terminate the existing Contract with the User for breach of contract by the User and without option for compensation for further damages, in the cases listed below, as well as in all other cases where this right is provided for in the present Terms and Conditions:

• Failure and/or delay in payment of amounts due under the Tariff Plan or under these Terms and Conditions;

• Inaccuracy and unreliability of the information provided to the Company through the LINK application during registration or thereafter, including creation of multiple accounts by one person in order to abuse promotional codes, credits or other discounts, or otherwise evade these Terms and Conditions;

• If the User is sanctioned, or has been proven to have driven, under the influence of alcohol, drugs or other psychotropic substances;

• Failure to return a scooter or if it is driven by a person other than the User;

• Negligent or intentional facilitation or commission by the User of theft, vandalism to the detriment of one or more scooters;

• If the User incurs penalties for violation of the Highway Code or applicable regulations;

• If the User, for a cause attributable to him/her, has caused an accident with a pedestrian or vehicle or damage to the scooter.

19.5 Em caso de rescisão do Contrato por qualquer das razões acima referidas, a Empresa tem o direito de aplicar uma penalização ao Utilizador de acordo com o Plano Tarifário em vigor no momento da rescisão, sem prejuízo da responsabilidade pelo prejuízo que a Empresa tiver em consequência da perda ou deterioração da trotinete, nos termos do art. 807º do Código Civil Português.

19.5 In the event of termination of the Contract for any of the above reasons, the Company has the right to apply a penalty to the User in accordance with the Tariff Plan in force at the time of termination, without prejudice to the Company's liability for any losses incurred as a result of the loss or deterioration of the scooter, under the terms of art. 807 of the Portuguese Civil Code.

19.6 A rescisão do contrato por qualquer razão determinará o direito da Superpedestrian de tomar imediatamente posse da trotinete e a obrigação do Utilizador devolver a trotinete.

19.6 Termination of the contract for any reason will determine Superpedestrian's right to immediately take possession of the scooter and the User's obligation to return the scooter.

ARTIGO 20 - INFORMAÇÃO OBRIGATÓRIA FORNECIDA PELO UTILIZADOR

ARTICLE 20 - MANDATORY INFORMATION PROVIDED BY THE USER

20.1 O Utilizador deve notificar a Empresa em caso de: Modificação do número de telefone da conta do Utilizador; Expiração, perda, roubo ou defeito do cartão de crédito ou de débito;

20.1 The User must notify the Company in case of: Change of the mobile telephone number for the User’s account; Expiration, loss, theft or defect of the credit or debit card;

20.2 O Utilizador deve garantir que os seus dados pessoais registados na Aplicação LINK estão sempre atualizados; estes dados incluem: Primeiro e último nome; Detalhes do Cartão de Crédito e/ou Cartão de Débito submetidos através da aplicação LINK ao fornecedor de serviços de pagamento; Número de telefone utilizado no dispositivo.

20.2 The User must ensure that their personal data registered with the LINK Application is always up to date; these data include: First and last name; Payment information submitted through the LINK app to our payment provider; Mobile telephone number used on the device.

20.4 O Utilizador será considerado responsável pela Empresa por qualquer dano ou perda, mesmo indireta, devido ao não cumprimento do presente artigo.

20.4 The User will be held liable by the Company for any damage or loss, even indirect, due to non-compliance with this article.

20.5 A Empresa compromete-se a cumprir os regulamentos europeus e estatais sobre proteção de dados ("RGPD"). Contudo informará os dados do Utilizador no caso de ser solicitada pela polícia ou pelas autoridades governamentais no exercício das suas funções e ainda para efeitos de ativação do Seguro.

20.5 The Company undertakes to comply with European and state regulations on data protection ("GDPR"). However, it will provide the User's data in the event that it is requested by the police or government authorities in the performance of their duties and also for the purpose of activating the Insurance.

ARTIGO 21 - COMUNICAÇÃO SOBRE PROTECÇÃO DE DADOS

ARTICLE 21 - COMMUNICATION ON DATA PROTECTION

21.1 A Empresa está sujeita ao dever de sigilo profissional e obriga-se a tratar os dados fornecidos pelo Utilizador, de forma lícita, leal e transparente, respeitando o Regulamento Geral sobre a Proteção de Dados (RGPD) nº 2016/679 e demais legislação aplicável, em Portugal, ao tratamento de dados das pessoas singulares, designadamente a Lei 58/2019, como referido na Política de Privacidade da empresa.

21.1 The Company is subject to the duty of professional secrecy and undertakes to process the data provided by the User, in a lawful, loyal and transparent manner, respecting the General Regulation on Data Protection (RGPD) No. 2016/679 and other legislation applicable in Portugal to the processing of data of natural persons, namely Law 58/2019, as set forth in the Company’s Privacy Policy

21.2 Para efeitos da celebração do Contrato e controlo de atividade da Empresa por parte de Entidades legalmente autorizadas, a Empresa tem de recolher, processar, armazenar e utilizar os seguintes dados pessoais do Utilizador: nome, informações sobre métodos de pagamento e número de telemóvel no dispositivo utilizado para registro na aplicação bem como informações relacionadas com o Contrato, tais como a localização da trotinete durante o Aluguer, o local onde o Utilizador começa e termina o Aluguer e a duração da utilização da trotinete.

21.2 For the purpose of the conclusion of the Contract and control of the Company's activity by legally authorized Entities, the Company must collect, process, store and use the following personal data of the User: mobile phone number on the device used to register with the app payment information submitted through the Company’s app to our payment provider; as well as information related to the Contract, such as the location of the scooter during the Rental trip, the place where the User starts and ends the Rental trip, and the duration of the use of the scooter.

21.3 As trotinetes estão equipadas com dispositivos de geolocalização. Cada trotinete está também equipada com um dispositivo GPS que, ao detetar a posição e as condições das trotinetes em tempo real e de forma ininterrupta, pode monitorizar a atividade de condução do utilizador e recolher dados relacionados com a condução, tais como travagem brusca, aceleração súbita, curvas, velocidades das trotinetes, que estão integradas com outros dados contextuais (por exemplo, condições atmosféricas, hora do dia, etc.).

21.3 The scooters are equipped with geolocation devices. Each scooter is also equipped with a GPS device that, by sensing the position and conditions of the scooters in real time and uninterruptedly, can monitor the user's driving activity and collect driving related data such as hard braking, sudden acceleration, cornering, scooter speeds, which are integrated with other contextual data (e.g. weather conditions, time of day, etc.).

21.4 Os dados relacionados com o comportamento de condução e dados de geolocalização podem ser processados como parte de uma verificação da utilização de trotinetes para proteger os bens da Empresa / LINK, para análise estatística e agregada da utilização de trotinetes para melhorar o Serviço e proteger os bens da Empresa e ainda para cumprimento de obrigações legais ou acionamento do Seguro

21.4 Data related to driving behavior and geolocation data may be processed as part of a check on the use of scooters to protect the Company's / LINK's assets, for statistical and aggregate analysis of the use of scooters to improve the Service and protect the Company's assets, and also for compliance with legal obligations or triggering of Insurance.

21.5 A Política de Privacidade da Empresa consta de documento autónomo acessível na página e a sua leitura e compreensão é condição necessária para a celebração do Contrato.

21.5 The Company's Privacy Policy is contained in a separate document accessible on the web page, which you must readand understand as a necessary condition for entering into the Contract.

21.6 De acordo com a Política de Privacidade da Empresa, o Utilizador pode designadamente, a todo o tempo:

• Solicitar e receber informações e acesso a todos os dados pessoais que lhe digam respeito na posse da Empresa;

• Solicitar a modificação ou eliminação dos seus dados pessoais, ressalvadas as obrigações legais de arquivo por parte da Empresa;

• Retirar o seu consentimento ao tratamento e armazenamento de dados ressalvadas as obrigações de arquivo legal obrigatório a que a Empresa está sujeita;

• Conhecer os fins para os quais os seus dados pessoais são tratados e os destinatários aos quais os dados pessoais podem ser divulgados (sujeitos a requisitos legais e regulamentares);

• Corrigir e atualizar os seus dados pessoais;

• Obter cópias dos dados pessoais que lhe dizem respeito e que estão a ser processados;

• Exercer o seu direito de opção no sentido de os seus dados não serem transmitidos a Entidades Terceiras que não tenham o direto de acesso aos mesmos para cumprimento de obrigações legais e dentro dos limites e finalidades especificamente previstos, designadamente para auditoria fiscal e da organismo de tutela da atividade da Empresa.

• Fornecer e a qualquer momento retirar o seu consentimento à mera receção de comunicações de marketing e promocionais;

21.6 In accordance with the Company's Privacy Policy, the User can:

• Request, receive and access all his/her own personal data and information held by the Company;

• Request the modification or deletion of their personal data, subject to the legal obligations of the Company to archive it;

• Withdraw the consent to the processing and storage of his/her own data, subject to the Company's mandatory legal obligations;

• Know the purposes for which the personal data is processed and the adressees to whom it may be disclosed (subject to legal and regulatory requirements);

• Correct and update his/her own personal data;

• Obtain copies of the his/her own personal data that is being processed;

• Exercise the right to opt out of the distribution of data to Third Parties that are not legally required to access them or that are specifically identified, which excludes namely tax or other audits.

• Provide and withdraw, at any time, the consent to receiving marketing and promotional communications;

ARTIGO 22 - LEI E TRIBUNAL DE JURISDIÇÃO E RESOLUÇÃO ALTERNATIVA DE LITÍGIOS

ARTICLE 22 - LAW AND COURT OF JURISDICTION AND ALTERNATIVE DISPUTE RESOLUTION

22.1 O Acordo é regido pela lei portuguesa.

22.1 The Agreement is governed by Portuguese law.

22.2 Para qualquer litígio resultante, relacionado ou decorrente do Contrato, terão competência os tribunais da área de jurisdição da cidade correspondente à Área Operacional.

22.2 For any dispute arising out of, relating to or resulting from the Contract, the courts of the area of jurisdiction of the city corresponding to the Operational Area shall have jurisdiction.

22.3 Para qualquer controvérsia ou litígio de consumo que surja em relação ao contrato em relação a Serviços o Utilizador pode recorrer à Resolução Alternativa de Litígios. O local da celebração do contrato é determinante para saber qual o centro de arbitragem competente:

• Para o Serviço prestados na Cidade de Lisboa é competente o Centro de Arbitragem de Conflitos de Consumo de Lisboa , através dos seguintes contactos:

22.3 For any controversy or consumer dispute that arises in relation to the contract in relation to Services, the User can resort to Alternative Dispute Resolution. The place of conclusion of the contract is determinant to know which is the competent arbitration center:

• For services rendered in the City of Faro, the Consumer Conflict Arbitration Center of Faro is the competent one

• For the remaining national territory, the National Center for Information and Arbitration of Consumer Conflicts is competent,

ARTICLE 23 - COMPLAINTS AND COMMUNICATIONS BETWEEN THE COMPANY AND THE USER

ARTIGO 24 – DIVERSOS

ARTICLE 24 - MISCELLANEOUS

24.1 Se a Empresa não aplicar os direitos faculdades previstas no presente Acordo, tal conduta não será de forma alguma interpretada como uma renúncia a tais direitos e poderes, nem impedirá a Empresa de solicitar o cumprimento integral, atempado e estrito do Acordo.

24.1 If the Company fails to enforce the rights and powers provided in this Agreement, such conduct shall in no way be construed as a waiver of such rights and powers, nor shall it prevent the Company from requiring full, timely and strict compliance with the Agreement.

24.2 Qualquer invalidade e ineficácia de uma ou mais cláusulas destes Termos e Condições, também derivadas de alterações à legislação em vigor, não afetará a validade do Contrato. Quando uma cláusula é inválida, inaplicável ou ineficaz, as partes devem substituir esta disposição por outra, válida, aplicável e eficaz, que tenha o efeito mais semelhante ao pretendido pela cláusula substituída.

24.2 Any invalidity and ineffectiveness of one or more clauses of these Terms and Conditions, also derived from changes in the legislation in force, will not affect the validity of the Contract. When a provision is invalid, unenforceable or ineffective, the parties shall replace this provision with another, valid, enforceable and effective provision, which has the effect most similar to that intended by the replaced provision.

24.3 A Empresa pode ceder ou transferir estes Termos e Condições, no todo ou em parte, ou os direitos e obrigações deles decorrentes, desde que para: uma subsidiária ou empresa associada; uma empresa do grupo; um adquirente do capital, negócio ou ativos ou um sucessor após a fusão, mas não a terceiros sem comunicação prévia ao Utilizador para efeitos de consentimento ou desistência do Contrato.

24.3 The Company may assign or transfer these Terms and Conditions, in whole or in part, or the rights and obligations hereunder, provided to: a subsidiary or associated company; a group company; an acquirer of the capital, business or assets or a successor after merger, but not to third parties without prior notice to the User for the purpose of consenting to or withdrawing from the Contract.

TABELA DE TAXAS

FEE SCHEDULE

1 - Tarifas aplicadas pela Empresa ao serviço de aluguer de trotinetes:

• Taxa por minuto: 0,25 euros.

• Taxa de desbloqueio: 1,00 euros. 1 - Rates applied by the Company to the scooter rental service:

• Fee per minute: €0.25.

• Unlocking fee: 1,00 euros.

2 - Sanções aplicadas pela Empresa:

• Danos à trotinete devido a causas atribuíveis ao Utilizador: desde um montante mínimo de 100,00 euros até um máximo de 500,00 euros;

• Utilização da trotinete fora da Área Operacional: 10,00 euros;

• Aplicação de sanções administrativas para o Utilizador: 20 euros como reembolso dos custos preliminares e de gestão do processo;

• Utilização do Serviço pelo Utilizador contrária à Lei, segurança rodoviária e mobiliário urbano: desde um montante mínimo de 50,00 euros até um máximo de 200,00 euros.

• O Plano Tarifário está sujeito a alterações e actualizações por parte da Empresa. Estas alterações serão previamente comunicadas aos utilizadores na aplicação. 2 - Penalties applied by the Company:

• Damage to the scooter due to causes attributable to the User: from a minimum amount of €100.00 to a maximum of €500.00;

• Use of the scooter outside the Operational Area: 10.00 euros;

• Application of administrative penalties to the User: 20 euros as reimbursement for preliminary costs and management of the process;

• Use of the Service by the User contrary to the Law, road safety and urban furniture: from a minimum amount of 50.00 euros up to a maximum of 200.00 euros.

• The Tariff Plan is subject to changes and updates by the Company. These changes will be communicated to users in the application prior to taking effect.
